This website is not directed to children under 13 years old. By accessing or using this website are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms herewith in.

b. Order Acceptance: Ayan Beauty reserves the right to refuse orders. All orders are subject to acceptance by Ayan Beauty.

c. Terms of Purchase: By placing an order, Users agree to our Terms of Purchase and is bound by them.

d. Fulfillment and Finality: Fulfillment and delivery times may vary, but once products are fulfilled, sales are considered final. Any postal delays resulting in delayed delivery are considered force majeure and Ayan Beauty will not be liable or responsible for.

e. Intended Use: Products on our Website are intended for personal or professional use and are not for resale.

a. Registration: Users may opt to register for a user account or promotions. In doing so, Users are responsible for providing accurate and current information strictly for their personal use.

d. We have the right to cancel or suspend your registration for any reason or for no reason at any time, at our sole discretion.

By providing email and/or phone contact details, Users consent to receive texts, calls, and emails from Ayan Beauty and its agents/affiliates, including automated messages and calls. Users have the option not provide such consent and/or can opt-out at any time. If you chose not to provide your consent do not provide us with your phone number.

**11. Purchases**

Users have an opportunity to review and modify orders before finalizing them. Once a User clicks the ‘pay now’ button at the end of the checkout process, an order placement confirmation is received. This does not constitute order acceptance. Order acceptance occurs upon fulfillment and dispatch from our warehouse. A ‘dispatched confirmation’ email will be sent to You. The purchase is only final after You receive a ‘dispatch confirmation’ email.  If Ayan Beauty is unable to accept an order for any reason, Users will be notified by email, and no charges will be incurred. If we are unable to accept your order, and payment was taken prior to non-acceptance of your order then we will refund you the full amount. Please note that this can take up to 7 business days for bank processing. In all other cases order are final, non-cancellable and non-refundable, except as specified under clause 14 and 15. Due to hygiene issues we do not accept returns or exchanges of products.

**12. Order Changes**

Once an order is placed by the User and payment is processed, changes to order details, such as delivery address or product types/quantities, are not possible. **13. Availability**

The acceptance and availability of orders are contingent upon the shipping destination and subject to availability. In the event of supply difficulties or lack of stock, either we will send you an email advising you that we are unable to fulfill your order or one of our customer service team members will contact you.

**14. Shipping and Delivery**

a. Estimates and Confirmation: Shipping and delivery dates are estimates and vary by destination. Confirmation will be provided after product shipment. Estimated delivery dates and times are not guaranteed.

b. Delayed Shipping: If Ayan Beauty is unable to ship products within the specified time frame or within ninety days of order confirmation, Ayan Beauty may request User consent to a shipping delay and/or alternative solution. Absent such consent, Ayan Beauty will cancel the order and issue a refund, including shipping fees, within seven business days. 

c. Inaccurate or Incomplete Shipping Information: It is the Users responsibility to provide Ayan Beauty with complete and accurate delivery address information. Ayan Beauty will not be liable for information supplied by Users that is incorrect or incomplete. 

d. Shipping costs: You will pay all shipping and handling charges specified during the ordering process. Please review carefully before you finalize your order.

e. Risk of loss: You are responsible for a product from the time we deliver the product to the address you provided. The risk of loss and title for products purchased pass to you upon delivery.

**15. Refunds, Returns, and Cancellations**

a. Finality: All sales are final, non-cancellable, and non-refundable, except as specified herein. Due to hygiene reasons, we do not accept returns or exchanges.

b. Damaged Products: Users are entitled to a refund if products arrive damaged. This does not affect Users' statutory rights. In the event your claim is substantiated and justified, the purchase price and shipping cost will be reimbursed within fourteen (14) days from the time the claim is substantiated and justified. Claims must be submitted via email to shop@ayanbeauty.com within forty-eight (48) hours of delivery. Include in the subject line  ‘damaged products received’. Please see Refund Policy for further details.

c. Refund Request: To request a refund, Users must contact Ayan Beauty's customer support team at shop@ayanbeauty.com within forty-eight (48) hours of delivery, and state in the subject line the reason for the request (i.e. ‘damaged products received’), along with the purchase receipt, photo of damaged product and User contact details to include (your full name, physical address, order number, reason for request, phone number, email address). Please see below refund process which may apply at the discretion of Ayan Beauty.

d. Refund Process: Ayan Beauty, at its sole discretion, may request additional photos of the damaged product and packaging, and a copy of the sale, including a confirmation and dispatch emails and credit card receipt. Alternatively, Users may be asked to return the product to Ayan Beauty's fulfillment center at Ayan Beauty's expense. Refunds will be issued based on the original form of payment.

**16. Payments and Price**

a. Currency: Prices are denominated in US dollars and are valid exclusively within the United States. Final price will be indicated at final checkout. 

b. Pricing Changes: Product pricing listed may change periodically and does not encompass shipping, handling, or taxes. Shipping, handling and taxes are calculated and applied at final checkout for the Users confirmation and acceptance.

c. User Responsibility: Users are responsible for shipping, handling, and tax charges. Depending on the delivery location, additional import duties and fees may be payable by Users upon receipt.

d. Payment Methods: Payment methods include Visa, Mastercard, Discover Card, Diner Club, American Express, PayPal, Amazon Pay, Apple Pay, Google Pay, and Shop Pay. These third-party payment processors collect and retain Users' credit card information for payment processing. If you choose a direct payment gateway, your data is stored through Shopify’s data storage, databases and general Shopify application. You should also read Shopify’s privacy statement (https://www.shopify.com/legal/privacy), by submitting your order you are agreeing to Shopify processing your order. Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. Payments from non-US dollar denominated payment account may incur additional charges and foreign exchanges differences. These charges and exchange rates applied are outside of our control and the responsibility of the User. You represent and warrant that (1) the credit card information you supply is true, correct and complete, (2) you are duly authorized to use such credit card for the purchase, (3) charges you incur will be honored by your credit card company, and (4) you will pay charges you incur at the posted prices, including shipping and handling, and all applicable taxes, if any, regardless of the amount quoted on the website at the time of your order. 

**17. Product Restrictions**

If legal or other constraints prevent the sale or delivery of specific products to Users, Ayan Beauty shall not be held liable in relation to such products in all cases to include but not limited to restrictions that prohibits us to sell or deliver to You. In the event of such restrictions is enforced after you have placed your order with us, we will do our best to notify you as soon as reasonably practical.

**18. Discounts and Promotions**

a. Code Usage: Users may only use one discount code at a time. Ayan Beauty reserves the right to cancel orders where Users apply more than one discount code to their basket. 

b. Code Terms: Discount codes are governed by their specific terms and conditions. In case of conflict, the promotion code prevails.

c. Code Transfer: Users may not assign, sell, trade, barter, or transfer promotions. Ayan Beauty retains the right to modify, terminate, or suspend the availability of promotions and to rectify errors or inconsistencies in promotion-related material.

d. Liability Release: By participating in a promotion, Users release Ayan Beauty and its agents from any liability, loss, or damage arising from participation or the receipt, use, or misuse of any prize or premium received.

**19. Arbitration, Governing Law, and Jurisdiction**

a. Binding Arbitration: Users agree that any and all claims arising from or relating to these Terms, any goods, or services provided by Ayan Beauty to Users and/or the entity they represent shall be subject to binding arbitration pursuant to the Federal Arbitration Act ("FAA"). This includes claims under contract, tort, equity, statute, or otherwise, as well as claims regarding the scope and enforceability of this provision.

b. Arbitration Process: A single arbitrator shall adjudicate all claims and render a final written decision. Users may choose the American Arbitration Association ("AAA"), JAMS, or another similar arbitration service provider acceptable to Ayan Beauty for arbitration administration. The appropriate AAA rules, JAMS rules, or service provider rules shall apply, as determined by the arbitrator. For AAA and JAMS rules, refer to www.adr.org and www.jamsadr.com.

c. Class Action Waiver: Users waive any rights to bring representative claims on behalf of a class of individuals or entities or on behalf of the general public (the "Class Action Waiver"). The arbitration provision may be severed or modified as necessary to render it enforceable.

d. Arbitration Cost: Each party bears its own cost of arbitration, unless otherwise required by the relevant arbitration rules. If you cannot afford your arbitration cost, you may apply for a waiver under the relevant rules. 

**20. Limitation of Liability**

Ayan Beauty does not disclaim liability where such exclusion would be unlawful. If applicable law does not allow all or part of the following limitations of liability to be applied to you, these limitations will apply to the maximum extent permitted by applicable law.

Subject to the above, under no circumstances shall we (including our parent company, subsidiaries, affiliates, officers, directors, members, employees, or agents) be liable to you for any loss, damage (whether direct, indirect, punitive, actual, consequential, incidental, special, exemplary, or otherwise), costs, expenses, liabilities, or penalties, whether arising from contract, tort, breach of statutory duty, or otherwise, whether foreseeable or unforeseeable, in connection with:

- Any data corruption or loss.

- Any inability to access our website, including interruptions, suspension, or withdrawal of our website (for any reason).

In the event that you incur damages, losses, or injuries arising from our actions or omissions, any damages caused to you are not irreparable or sufficient to warrant an injunction preventing the exploitation of any website, service, property, product, or content owned or controlled by us. You agree to cooperate fully with Ayan Beauty in the defense of any claim and to promptly provide all necessary information, assistance, and documents. Ayan Beauty reserves the right to assume exclusive control and defense of any matter subject to your indemnification, and you may not settle any claim without the prior written consent of Ayan Beauty.

This defense and indemnification clause is a fundamental part of our agreement and is designed to protect Ayan Beauty from legal and financial liabilities arising from your use of our e-commerce platform and services. By using our platform, you acknowledge and agree to the terms of this clause.

Pursuant to US law, Users must be 18 years of age or older.
